We know that going through a divorce can be a stressful time. At Irwin Mitchell we help guide you through the process so it’s as straightforward as possible.
We handle everything from the instruction to finalising the divorce, which usually takes around six months, and you won’t even need to go to court. You’ll also have your own legal advisor on hand throughout every stage of the process.
How it works
We talk you through the process and what is right for you and your situation.
Once we’ve agreed it’s the right way forward for you, you can pay over the phone.
We’ll then either issue the divorce paper – known as the petition – or respond to it.
From that point we’ll take care of all of the paperwork, including correspondence with the court and your spouse until the divorce is confirmed.
All we need to start with are your contact details. Later on we’ll need to see your marriage certificate, photo ID and a document that shows your current address.
How much it costs
£540
If you’re the one filing for divorce, our cost is £540. There is also a standard court fee of £550 that must be paid separately.

If you are responding to the divorce petition, our cost is £264, and there are no court fees.

Reasons for divorce
You will need to show that your marriage has broken down and give a reason for wanting to get divorced. If you haven’t been separated for longer than two years you can give adultery, desertion or unreasonable behaviour as grounds for divorce.
After two years of separation you can file for divorce based on no fault, if both parties agree. If you’ve lived apart for more than five years, you do not need a reason for wanting a divorce.
